This Privacy Policy explains how Valentyna Zhytnyk, doing business as Art of Gems (“Art of Gems,” “we,” “us,” or “our”), collects, uses, discloses, and protects personal information when you visit https://www.artofgems.studio, contact us, or purchase an artwork or other product from us (collectively, the “Services”).
Our store is hosted on Shopify. Shopify provides the ecommerce platform, checkout, payment, fraud-prevention, analytics, and related services that allow us to operate the store.
1. Personal Information We Collect
Depending on how you interact with the Services, we may collect:
- Contact information, including your name, email address, telephone number, billing address, and shipping address.
- Order information, including the products you purchase, order history, transaction status, delivery information, and communications concerning your order.
- Payment-related information. Payments are processed through Shopify Payments or another payment method offered through Shopify checkout. We do not directly receive or store your full payment card number or card security code.
- Account information, if customer accounts are enabled, including login and account preferences.
- Communications, including information you provide when contacting us or asking about an artwork, order, delivery, return, or other matter.
- Device and usage information, including IP address, browser and device type, pages viewed, referring pages, session information, and interactions with the store.
- Cookie and similar technology information, as described below.
2. How We Collect Personal Information
We collect personal information:
- directly from you when you place an order, contact us, or use the Services;
- automatically through Shopify, cookies, and similar technologies when you browse the store;
- from service providers that help us operate the store, process payments, prevent fraud, fulfill orders, and provide customer support; and
- when permitted by law, from publicly available or other legitimate sources.
3. How We Use Personal Information
We may use personal information to:
- provide and operate the Services;
- process and fulfill orders;
- process payments and confirm transactions;
- arrange shipping, delivery, returns, refunds, and customer support;
- respond to questions and communicate with you about artworks and purchases;
- maintain store security, prevent fraud, and protect our rights and customers;
- understand store traffic, orders, and performance through Shopify’s built-in analytics;
- comply with tax, accounting, legal, regulatory, and recordkeeping obligations;
- establish, exercise, or defend legal claims; and
- improve the store and customer experience.
We do not currently send newsletters or promotional marketing emails. We may send transactional or service-related communications concerning your inquiries, orders, payments, shipping, returns, security, or legally required notices.
We do not use Google Analytics.
4. Legal Bases for Processing
Where applicable law requires a legal basis, we process personal information:
- to perform a contract with you, including processing and delivering an order;
- to comply with legal obligations;
- for our legitimate interests, including operating and improving the store, preventing fraud, securing the Services, and responding to inquiries; and
- with your consent where consent is required, including for certain cookies or similar technologies.
You may withdraw consent at any time where processing is based on consent. Withdrawal does not affect processing that occurred before the withdrawal.
5. Shopify, Payments, and Store Analytics
Our store is hosted by Shopify. Shopify processes personal information in connection with the storefront, checkout, payments, fraud prevention, store analytics, and other ecommerce services.
Payments are processed through Shopify Payments or another payment option made available through Shopify checkout. Payment providers process payment information under their own privacy terms. We do not directly receive or store full payment card details.
We use Shopify’s built-in analytics to understand matters such as store visits, sessions, orders, and store performance. We do not use Google Analytics or third-party advertising pixels at this time.

6. Cookies and Similar Technologies
Shopify and its service providers use cookies and similar technologies to:
- operate the storefront and checkout;
- remember preferences and maintain sessions;
- provide security and fraud prevention;
- understand store usage and performance; and
- comply with applicable legal requirements.
Where required, visitors are given choices concerning non-essential cookies through the store’s privacy and cookie settings. You can also control cookies through your browser settings, although disabling necessary cookies may prevent parts of the store or checkout from working correctly.
We do not currently use Google Analytics or third-party advertising pixels. If our analytics, advertising, or cookie practices change, we will update this Privacy Policy and the store’s consent settings as required.
7. How We Disclose Personal Information
We may disclose personal information to:
- Shopify and payment providers;
- shipping carriers, logistics providers, and fulfillment partners;
- technology, hosting, security, fraud-prevention, customer-support, accounting, and professional service providers;
- government authorities or other parties when required by law or necessary to protect rights, safety, or security;
- parties involved in a business transaction, such as a merger, acquisition, financing, reorganization, or sale of assets; and
- other parties at your direction or with your consent.
We do not sell personal information for money. We do not independently provide personal information to third parties for their own direct marketing. Shopify may process information as described in its own privacy policy and according to the privacy settings enabled for our store.
8. International Sales and Data Transfers
Art of Gems offers products to customers in countries and regions that are enabled and available at checkout. Availability, shipping methods, prices, taxes, duties, payment options, and delivery times may vary by destination.
Because we sell internationally and use Shopify and other service providers, personal information may be processed in the United States, Canada, or other countries where we or our service providers operate. Those countries may have data-protection laws different from the laws in your country.
Where required, we and our service providers use lawful measures for international data transfers.
9. Data Retention
We retain personal information only for as long as reasonably necessary to:
- provide the Services and complete transactions;
- maintain business, tax, accounting, and legal records;
- resolve disputes and enforce agreements;
- prevent fraud and protect the Services; and
- satisfy applicable legal or regulatory requirements.
Retention periods vary according to the type of information and the purpose for which it was collected.

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

The Services are not directed to children, and we do not knowingly collect personal information from children in violation of applicable law. If you believe a child has provided personal information to us, please contact us so that we can review and, where appropriate, delete it.
